Madhya Pradesh High Court News: Madhya Pradesh High Court has granted divorce considering false accusations against husband and insulting him in public as mental torture. A husband has filed a petition in the High Court for divorce on the grounds that his wife is spreading false propaganda that she is going to drink. The High Court granted the divorce.
Both are government employees in this case. Married in 2004. They have been separated since 2017 after thirteen years. They have two children. Relations have been strained since 2015. 2017 started to be different. In 2015, the wife filed a petition under the Women’s Protection from Domestic Violence Act, alleging that the husband was committing mental and physical violence. A compromise was reached in Lok Adalat in 2011 regarding this. The husband admits to physical abuse and neglect and promises to be responsible for the wife and children. She says that her husband is suspicious of her. She says that she does not need a divorce and if her husband changes, they will stay together. At that time they were compromised.
But the husband filed a divorce petition in 2018 claiming that his wife was promoting him as a drunkard. He said that they have been living separately since 2017 because they are subjected to mental torture. He gave an affidavit in court that he does not drink alcohol.  In 2021, the family court rejected the husband’s petition. The husband went to the High Court. He argued that his wife’s false allegations of alcoholism caused mental torture and damaged his social status as a government employee. But the wife argued that it was just a normal couple’s quarrels…no serious cruelty.  She said that she did not torture her after the compromise. 
However, the court found that the false accusations of alcohol against the wife and husband had humiliated the husband in the social class.  It has been identified as a ‘serious affair’ rather than a simple quarrel as a government employee. It has been observed that it affects mental health.  The High Court allowed the husband’s appeal and granted the divorce on the grounds of mental violence.
